Franchise and Collection

We have negotiated more than 20 franchise and collection agreements and handled the full range of related issues, including franchise fees, recycling requirements, financing obligations, hours and terms of service, exclusivity requirements and performance guarantees.

The firm has successfully negotiated solid waste franchises and collection contracts in several states, including particularly California, where among other projects we helped establish the franchise and collection program supporting the Orange County landfill system.  The firm is engaged to represent the New York City Sanitation Department in connection with a proposed City-wide franchise collection program, and has represented more than a dozen California municipalities in solid waste collection and disposal franchise negotiations.  In Florida, we were retained by Polk County to prepare a unique performance specification for the County’s periodic household collection program, including criteria addressing safety, litter, reporting, missed pick-ups and timeliness of pick-ups.
