Municipal water utilities increasingly are turning to renewable energy sources to meet their energy supply needs. Our firm has an active procurement and contract practice for cogeneration, combined heat and power (CHP), digester gas, and solar projects that furnish electricity and thermal energy to water and wastewater treatment plants. For DC Water, Hawkins provided legal advisory services for both a design-build-operate-maintain CHP project procurement and a design-build/P3 solar energy facility procurement. Our water team served in the same capacity on several similar projects for Camden County (New Jersey) Municipal Utilities Authority’s wastewater treatment system. In San Diego, the firm is structuring and negotiating on behalf of the City a major landfill gas-to-energy P3 project that will power a new advanced water purification (indirect potable reuse) project being implemented under the City’s broad-ranging Climate Action Plan. Additional illustrative projects include the City of San Jose’s digester gas cogeneration progressive design-build project, Washington Suburban Sanitation District’s thermal hydrolysis and CHP progressive design-build project, and Rahway Valley Sewerage Authority’s food waste feedstock supply project for biosolids digester gas cogeneration.
